Minutes of Stated Meeting

ARTICLE I - QUALIFICATION OF MEMBERSHIP

SECTION 1 - WHO MAY APPLY?

Membership in the Association is open to anyone interested in Officiating and is acquired through becoming a member in good standing of the Victoria Basketball Officials Association.

SECTION 2 - HOW TO APPLY?

An applicant must apply to the Association. Applicants for Active Membership shall indicate their desire to an Association representative and shall successfully pass the following requirements:

  1. Establish a good record of health and character; and

  2. Follow the certification and development program.

SECTION 3 - LAPSED MEMBERSHIP

A member who has allowed his membership to lapse beyond April 1st of the ensuing basketball season shall be required to retake the written and floor examinations to reinstate his membership.

SECTION 4 - DRESS

The dress code for all officials in the Association is as follows:

  1. Prescribed grey shirt with approved crest;

  2. Black trousers;

  3. Black belt with simple buckle;

  4. Black sneakers;

  1. Black socks;

  2. Black whistle and lanyard; and

  3. Black CABO warm-up jacket (optional).


Note: First year officials are to have a minimum of shirt, whistle and lanyard (black) are expected to purchase the remaining uniform before next season.


SECTION 5 – CONDUCT

  1. Unacceptable:

    1. Reporting for assignments in an unfit condition;

    2. Repeated lateness for assignments;

    3. Failure to maintain clean and prescribed dress;

    4. Accepting games without the Allocator’s knowledge; and

    5. Any conduct which brings this Association or any of it’s members into disrepute.

  1. An official should always attempt to act in a calm and professional manner when dealing with coaches and players.

  2. An official should never let personal feelings interfere with their conduct.

  3. An official must treat every game as an important one and never show disinterest in the game.

  4. An official shall check with the minor officials to reduce errors.

  5. An official shall always support their partner; discussions should occur away from the court.

ARTICLE II - DISCIPLINE OF MEMBERS

SECTION 1 - GROUNDS

For failure to comply with established authority of regulations of the Association, or for delinquency in payment of authorised charges, or for other conduct conclusively established to be contrary to the best interest of basketball, a member may be suspended from the Association for a specific time period, or expelled. Other appropriate measures may be taken at the recommendation of the Discipline Committee.

SECTION 2 - APPEAL

Any member subject to disciplinary action shall have the right to appeal to the Executive Committee. In the case of expulsion, the Executive Committee shall present the findings to the membership in accordance with this Constitution.

SECTION 3 - NOTICE OF FINDING

When a member is suspended or expelled, or some other appropriate action is taken, the Chairperson shall notify the total Executive Committee that such member is no longer able to accept assignments to officiate as a member of the Association. No member in good standing shall officiate any game with a suspended or expelled member.

ARTICLE III - FEES, ASSESSMENTS AND EXPENSES

SECTION 1 - ASSOCIATION DUES

Each member shall pay dues set at the fall general meeting before the date set at that meeting, to the Assignor-Treasurer. These dues are collected to become a member of the Provincial and Canadian (CABO) Associations. With these dues comes the "Full Court Press", "Baseline" and "Post Play" publications, the national exam, rules interpretations and education, facilitation of provincial and national playoff assignments and membership in "Basketball BC".

SECTION 2 - ALLOCATION FEES

These fees are retained from game fees. (11.5%) The distribution of these fees shall be:

  1. Allocator/Treasurer – a minimum of $5000 or up to 60% of the total allocation fee as determined by the Executive Committee.</p>

  2. Educator/Interpreter – a maximum of 15% of the total allocation fee as determined by the Executive Committee.

  3. Expenses – 17% of the total allocation fee.

  4. Executive Committee – 3% of the total allocation fee.

  5. Balance – 5%

ARTICLE IV - RULES OF PROCEDURE

SECTION 1 - QUORUM

The quorum for the transaction of business at any general meeting shall be at least one-half of the total membership of the Executive Committee, plus all other members present.

SECTION 2 - RULES OF ORDER

The recognised rules of order for all meetings shall be "Roberts".

ARTICLE V - STANDING COMMITTEES

There shall be several Standing Committee of the Association to assist with the stated goals and purposes of the Association. These committees are as follows:

SECTION 1 - EDUCATION COMMITTEE

The educator/interpreter shall chair this committee and shall include other members as appointed by the Chairperson. Responsibilities are as follows:

  1. The review and adaptation, as required, of the rating and upgrading procedures which apply to all officials including procedures to ensure the ongoing evaluation of officials; and

  2. The ongoing development and implementation of programs, utilising both new and existing resources, so as to increase rules and mechanics knowledge as well as the consistent application of these amongst all officials.

SECTION 2 - RATES AND BUDGET COMMITTEE

A member-at-large shall chair this committee. This committee shall be responsible for rates to be charged by the Association, after consultation with groups such as BCBOA, High School Athletic Associations, and V&DABA. The committee shall determine areas in which the Association funds might best be utilised, and shall search for new ways that the Association might generate revenue. The Budget Committee will assist the Treasurer to prepare a budget for the first meeting in September. This budget will be finalised for adoption at the October meeting. This committee will audit the Treasurer

SECTION 3 - AWARDS AND HONOURS COMMITTEE

A member-at-large shall chair this committee and shall consist of other members who wish to serve. The committee shall recommend for recognition those who have demonstrated a long term commitment to basketball officiating and in doing so have brought distinction to the Association, and to the sport as a whole. Recognition may take the forms of Life Memberships, Plaques, Certificates and nominations for other awards as appropriate.

SECTION 4 - DISCIPLINARY COMMITTEE

This committee shall consist of 3 members appointed by the Executive Committee. This committee shall be responsible for considering cases that may require disciplinary action, and shall, after hearing evidence, have the authority to make recommendations to the Executive Committee for appropriate penalties. The Executive Committee shall notify all involved parties, in writing, of any findings in a hearing and the penalties determined. Should any member of the Executive be directly involved, the Chairperson shall appoint a member-at-large to sit on the Executive Committee in their stead.

SECTION 5 - NOMINATING COMMITTEE

The Chairperson shall head this committee. This committee shall present a slate of candidates for all positions open at the Annual General Meeting. The Chairperson shall be an ex-officio, non-voting member of all standing committees to which he does not already belong to in an official capacity.

ARTICLE VI - CONFLICT OF INTEREST

All officials be directed to refuse all game assignments involving teams connected in any way with his immediate family, his employer (in the case of a student/teacher, his school) except in special circumstances as determined by the Assignor.

ARTICLE VII - CONDUCT AND ROLE OF OFFICIALS

All members must recognise that their conduct is closely scrutinised by the basketball community. Thus, when acting in the role other than an official (i.e. player, coach, spectator), exemplary conduct must be maintained with regards to their fellow officials; and responsibility lies within the whole membership to ensure that this conduct is maintained.

ARTICLE VIII - FINAL INTERPRETATIONS

When final interpretations of any item of these By-Laws is necessary between meetings of the Executive Committee, the Chairperson is the designated authority.

ARTICLE IX - AMENDMENTS

These By-Laws may be amended by a two-thirds majority vote of the Association members present at any meeting. However, if a special meeting is called for that purpose, written notice of the proposed amendment shall be regularly or electronically mailed to all members at least thirty (30) days prior to such a meeting.
