Searches Outside of Canada

  • Searches by Canadian government authorities made outside of Canada must comply with the search and seizure laws of the country in which the search was made. The provisions of s. 8 of the Charter of Rights do not apply
    [Hape, L.R.; {para 62} SCC].
  • Foreign government procedures do not have to comply with Canadian Charter requirements to provide information requested by Canadian governmental authorities
    [Schreiber, K.; {para 28} SCC].
  • Canadian authorities can apply to Canadian courts for intrusive warrants (here for a wiretap warrant), that will be executed in foreign jurisdictions. In this instance it was a well documented allegation of a breach of national security
