Disclaimer / Privacy Statement

By requesting and paying in advance for The Mail Executive services, the client states that he/she has read and agrees to The Mail Executive's Terms and Conditions. After paying for the services, the Client will have the use of The Mail Executive's shipping address. Customer access to mail and packages will be forwarded by The Mail Executive to the Client's mail-forwarding address as submitted on the Order Now page.

The Client agrees to use services in accordance with The Mail Executive's rules and in compliance with all Canadian Postal regulations, as well as local, provincial and federal statutes and regulations. Failure to do so may result in cancellation of service without notice. The Mail Executive intends to cooperate fully with appropriate law enforcement officials. THIS SERVICE IS NOT INTENDED FOR AND SHALL NOT BE USED FOR THE FORWARDING OF GENERAL MERCHANDISE FROM MAIL ORDER SUPPLIERS TO CUSTOMERS. The Mail Executive must be informed of any shipment requiring special attention in advance (i.e. Customs, certified, registered, insured, C.O.D. etc.), and all packages must be accompanied by a shipping document showing value and contents for the purposes of customs declarations.

The Mail Executive is not engaged for the delivery of mail and is therefore not responsible for failure of the Canadian Post Office or other postal or delivery service. Once The Mail Executive has handed over the Customer's mail to the Postal or Delivery Service, the mail is deemed to be delivered to the Client and The Mail Executive shall not be responsible for delays, loss, theft, or any damages.

The Mail Executive will forward first class mail and/or packages at the interval and level of service specified by the Client when the fee for service has been paid and there is an adequate deposit on hand to cover postage and handling fees. If The Mail Executive receives mail addressed to a Client who has not paid service fees or has an inadequate deposit on hand for postage and fees, The Mail Executive will attempt to contact the Client by e-mail to ask for instructions or an additional deposit. If the Client's account has been cancelled by Client's or if there is no response or additional deposit within ten business days, the mail will be handed over to the Postal Service for return to sender or in the case of a package, the package will be discarded.

Certified, registered, insured, or COD mail or parcels will only be accepted by The Mail Executive as agent for the Client, when the Client specifically authorizes same in advance, and provides full, advance payment of COD charges. Special handling fees will apply to receipt of COD mail and parcels as well as the forwarding of mail and parcels involving registration or insurance.

Clients are required to maintain a valid e-mail address. All notices by The Mail Executive shall be initiated by e-mail and shall constitute valid notice. The usual cost of forwarding at the level of service previously chosen by the Client will apply. If there is not an adequate deposit on hand, there will be no additional notices.

All fees and deposits are payable in US dollars and shall be paid using the Order Now section (using the PayPal processing system) on the site unless otherwise agreed by the Client and The Mail Executive (i.e. Visa, MasterCard, International/Postal Money Order).

The Mail Executive can and will ship anything, that is legal in Canada, to anywhere, subject to exceptions stated above when the services are paid in full in advance. The Client must be aware of products that are restricted in Customer's own country and refrain from ordering them. The Mail Executive shall not be liable in any way if customs officials seize all or part of a shipment, rightly or wrongly, or for whatever reason.

Customs duties and fees are the sole responsibility of the Client.

The Mail Executive's basic fees are due and payable in advance and notice thereof will be sent to the Client by e-mail. No other notice will be required. Failure to pay such fees when due may result in disruption or cancellation of services.

The Mail Executive does not prorate its fees and does not provide refunds in the event that the customer or The Mail Executive cancels service prior to the end of the term (or end date of the mailing services as determined by The Mail Executive). Refunds of unused deposits (less $10 administration fee plus any fees incurred for issuing payment and for postage) must be requested in writing within 30 days of termination of services as determined by The Mail Executive. The mail deposit refund will only be issued in the following formats WITH NO EXCEPTIONS: as a payment to a PayPal account or as an International Money Order or Bank Draft.

Upon termination of services by The Mail Executive or failure to pay fees in advance by the Client, The Mail Executive shall have no responsibility to make the Client's mail available without payment therefor.

The Mail Executive's basic fees may be paid by credit card using PayPal; all other expenses (for bulk mail or parcel forwarding, customs/duties fees, certifications, insurance, etc.) must be paid by pre-arranged method (i.e. bank draft, money order, etc.).

Disclaimer

The Client agrees to protect, indemnify, and hold harmless The Mail Executive from and against any and all claims, demands, and causes of action of any nature whatsoever relative to the use of The Mail Executive facilities or services, and any expense of The Mail Executive incurred in a defense against same shall be reimbursed by the Client. The Mail Executive is not liable in the event The Mail Executive commits or fails to commit any act resulting in disruption of service to Client and Client thereby suffers a loss. The Mail Executive shall not be liable for incidental or consequential damages as a result of its performance as agent for the Client.

The Mail Executive has created this privacy statement in order to demonstrate our firm commitment to privacy. The following discloses our information gathering and dissemination practices for www.The Mail Executive.com

Our site uses an order form for customers to request information, and services. We collect visitors' contact information (like their email address, mailing forwarding address, etc). Contact information from the order form is used solely to provide service to our customers. Financial information that is collected is used solely to bill the customer for services.

Except as provided for above, any personal information collected will not be disclosed to any third party, except in the case of cooperating with law enforcement agencies to aid in identifying those persons using our services for illegal activities. Information may be given even without a subpoena or court order if we believe such illegal activity is being conducted through our services.
