SALES AGREEMENT
WHEREAS, ROCKANNAND REGISTERED KENNEL hereinafter called "Seller" is the owner of a PET or SHOW/Breeding German Shepherd DOG or Bitch FURTHER DESCRIBED AS:

    WHEREAS, __________________________________________________________________________
is desirous of BUYING or CO-OWNING the animal described above:

NOW, THEREFORE, in consideration of the sum of: ____________________
and other conditions, _____________________________________________________________________
under the following WARRANTIES and CONDITIONS and no other WARRANTIES OR CONDITIONS either expressed or implied:

1. That the above described animal is purebred, registerable with the Canadian Kennel Club (CKC) or individual registration is signed to initiate transfer to the Buyer as of the date of sale. Seller will pay the initial costs of registration and transfer.

2. HEALTH GUARANTEE - 48 HOURS

Puppy shots and health examinations are given by our Veterinarian when the puppy reaches 8 weeks of age, however, at the option and expense of the Buyer, this animal may be taken to a Veterinarian for a second health examination within 48 hours of the time of sale or receipt of animal if shipped by air. Failure to do so will relieve the Seller of all liability. If this animal is found to be ill (excluding umbilical hernia) during this examination, the Seller must be notified immediately after the examination and the animal returned to the Seller at the Buyer's expense within 48 hours of examination with a signed statement from a Veterinarian. A replacement animal will be given if available, if not available, the sale price will be refunded if the condition of the animal has not changed (health. anatomical make-up, appearance & temperament), such change in condition relieves the Seller of all liability. 3. TEMPERAMENT - 72 HOURS

Should the Buyer question the temperament of this animal, he must notify us within 72 hours of receiving the animal. If necessary, it may be returned to us at the Buyer's expense for evaluation. Unless we deem the temperament problem to be the result of improper handling (lack of proper socialization and training, teasing or other abuse) by the Buyer, family members or his agent, we will replace the animal with one of equal value when available. NO CASH REFUNDS.
 
 

4. PET PLAN INSURANCE - I MONTH FREE

Pet Plan Insurance Co. (see pamphlet) will provide 1 mo. free Accidental Death coverage, valued at their current Silver Plan benefit. Enrollment in the total Plan for the first year of your pup's growth period is encouraged.

5. HIP and ELBOW GUARANTEES - 2 YEARS

Pet Quality

If lameness develops from the date of sale to the animal's second birthday, due to moderate or severe hip dysplasia or elbow dysplasia (not due to Panosteitis or injury), attested to by x-rays paid for by the Buyer and sent to the Seller's veterinarian for evaluation, the Seller agrees to replace the animal within 12 months with a suitable puppy or young adult of equal value to the animal at the time of sale. If a replacement animal is required, the Buyer will pay for the animal's disposition and send this certificate along with it's CKC registration papers to the Seller and the Buyer shall share the risk with the Seller regarding the status of the hips and elbows of the replacement. It is understood that this matter will be kept confidential between the Buyer and the Seller. NO CASH REFUNDS.

Show Quality

The Buyer agrees to have an OFA or OVC radiographic evaluation of pelvic and elbow phenotype with respect to canine hip and elbow dysplasia between 24 and 30 months of age. Should the animal not receive an OFA or OVC number for reasons other than quality of x-rays, the Seller will replace the animal at the first opportunity, (if shipped by air at the Buyer's expense) after receiving a copy of the OFA/OVC report from the Buyer. The Seller will offer a suitable replacement puppy or young adult of equal value to the animal at the time of sale OR the Buyer may keep the animal and receive a credit of the difference between pet and show price (if applicable) to be applied to another promising animal when available. (Buyer shall share the risk with the Seller regarding the status of the hips and elbows of the replacement). It is understood that this matter will be kept confidential between the Buyer and the Seller. Price difference noted at the time of sale: $ ___________________ NO CASH REFUNDS.

6. RETURNS

Should the Buyer be unable to keep the animal, the Seller reserves the right to exercise their option to take the animal back into their ownership if the animal in question is in good mental and physical health and can be placed. The returned animal must be accompanied by its owner-signed CKC Registration and Health Certificates. Depending on circumstances, the Seller may offer a 2 year credit towards a future animal.

Further, the Buyer agrees that the animal will never be sold or given to any retail or wholesale place where dogs are sold or resold to the public, nor to any research institution where experimental practices take place.
 
 
 
 

7. CKC NON-BREEDING AGREEMENT

It is understood that if the animal is purchased strictly as a family companion and pet, or as a working dog and not specifically to be used for breeding, the price and the registration will reflect this in the form of a Canadian Kennel Club - Non-Breeding Agreement, which shall be signed by the Buyers before the animal will be registered with the CKC, Spaying or Neutering the animal is encouraged to best preserve the breed.

8. BREEDING - SHOW ANIMALS ONLY

First Breeding/Second Heat - 18 Months/Preliminary X-ray - A radiographic evaluation of pelvic and elbow phenotype with respect to canine hip/elbow dysplasia is required.

Second Breeding - 24 to 30 Months of Age - OFA or OVC Certification is required. If the animal has produced "Get", the Seller is relieved of all liability.

Prior to breeding, if for some reason the show animal does not develop the way the Seller anticipated and is not showable or breed worthy because of a disqualifying fault or an inherited condition, the Seller will replace the returned animal (if shipped by air at the Buyer's expense), with a suitable puppy or young adult of equal value to the animal at the time of sale OR the Buyer may keep the animal and receive a credit of the difference between pet and show price to be applied to another animal when available, (Buyer shall share the risk with the Seller regarding the status of the hips and elbows of the replacement). It is understood that this matter will be kept confidential between the Buyer and the Seller.

9. CO-OWNERSHIPS

Conditions of Co-ownership gives the Buyer the opportunity to own a show quality female at a "pet" price. The Buyer maintains the bitch, (diet, housing, veterinary, showing & advertising) and agrees to actively show or trial the bitch to championship or CD status and advertise the achievement before repaying the Seller with puppies (to be negotiated at the time of sale). The Seller agrees to sign off the animal to the Buyer when these conditions have been met.

Conditions of Co-ownership gives the Buyer the opportunity to own a show quality stud dog at a "pet" price and the Seller maintains breeding rights and receives 1/2 the earned stud fees. The Buyer maintains the dog, (diet. housing, veterinary, showing & advertising) and agrees to actively show or trial the dog to championship or CD status and advertise the achievement. Any further transactions may be negotiated.
 
 
 
 
 
 
 

10. SHOWING

The Buyer must undertake to maintain the animal in show condition, including regular and proper exercise, bathing and grooming. The animal must be socialized and trained so that it is presented in the ring in a proficient manner. Futurity and Maturity nominated animals must be entered in their respective classes in any Canadian giving Futurity/Maturity Show.

Violations of this contract may make this Contract null and void or may be grounds for the Seller to file suit for damages in a Court of Law governed in the Province of BC Canada.
