Copyright
exists when a work is first created in tangible form.
In the case of paintings or sculptures, they are under copyright
protection the moment it is created and fixed in a tangible form
so that it is perceptible either directly or with the aid of
a machine or device. Photographic images including those of works
of art are also subject to copyright law.
There is no longer any requirement that a copyright
notice
be affixed to a work of art in order to have a valid copyright.
In other words, use of the copyright notice is optional.
