Acceptance of registration
2(5)
On acceptance of the application for registration the director shall record the information provided on the post-adoption registry and cross-reference it with the appropriate records.

Openness agreements, disclosure and contact vetoes

The director shall

(a) determine if an applicable openness agreement, a disclosure veto or a contact veto has been filed with repect to the adoption identified by the registrant; and

(b) inform the registrant about any applicable openness agreement, disclosure veto or contact veto in accordance with the Act.

Corresponding registration

If there is a corresponding registration on the post-adoption registry with respect to the same adoption and no applicable openness agreement, disclosure veto or contact veto, the director shall notify the corresponding registrants accordingly.

No corresponding registration

If there is no corresponding registation on the post-adoption registry with respect to the same adoption, the director shall advise the registrant accordingly and at the request of the registrant initiate a search in accordance with the Act.

There are no fees for searching or for non-identifying information. Vital statistic fees are all that may be required.

Before the director undertakes a search on behalf of a registrant, the registrant shall pay the applicable search fee and the vital statistics search fee as set out in the Schedule or provide evidence of eligibility for a waiver of the fees as set out in section 13.

Limitation re searching

No seasrch shall be undertaken by the director if it could result in contact between a minor adoptee and his or her adult birth sibling or birth parent, unless the adoptive parent or the person having care and custody of the minor adoptee consents in writing to the search.

Person wishes to exchange identifying information

If a person is contacted by the director as a result of a search by the director and the person wishes to exchange identifying information or to have personal contact with the registrant, the person must register on the post-adoption registry.

Adoption Act-refusal to have contact
9(1)
If,

(a) the person contacted by the director does not wish to have personal contact with the registrant; and

(b) the order of adoption for the adoption identified by the registrant was granted under The Adoption Act;

the director shall inform the person of the right to file a contact veto.


9(2)
If,

(a) the person contacted by the director does not wish to exchange identifying information or have personal contact with the registrant; and

(b) the order of adoption for the adoption identified by the registrant was granted under an Act that was a predecessor to The Adoption Act;

the director shall

(c) inform the registrant as to the response of the person contacted without providing identifying information about him or her; and

(d) record the person's response on the post-adoption registry.

No fees payable

No fees are payable by a person who registers on the post-adoption registry as a result of a search by the director.

Changes in information on the registry
11(1)
A person who is registered on the post-adoption registry must notify the director of any change of the person's name or address.

Correcting errors
11(2)
On being satisfied

(a) that a transcription error or an omission exists with respect to the information submitted for registration on the post-adoption registry; and

(b) about the facts to be recorded;

the director may correct the error or add the omitted information

Cancelling registration

A person who registers with the post-adoption registry may cancel the registration at any time by notifying the director in writing and the director shall record the cancellation on the post-adoption registry.

Waiver of fees

The following persons are entitled to a waiver of the fees required under this regulation:

(a) a person in receipt of income assistance, municipal assistance or general assistance under The Employment and Income Assistance Act;

(b) a person in receipt of income assistance under a program of the Government of Canada or another jurisdiction outside Manitoba other than an insurance benefit program or a loan program.
