COMPLAINT—Detective-Sergeant Thomas A. WHATLEY, Jr.
Dear Chief Schroeder:
My name is Karol MADERA. I am a Canadian
radio-amateur call sign VE7KFM and this is in support of George ZARDECKI’s
letter to you dated 10 June 2006.
I first became aware of your Tom WHATLEY,
amateur call sign N1FM [the ex-N1SOB], from monitoring ~14.275 MHz in early
January 2006.
Your WHATLEY—who on-air has a characteristic
voice, ‘bully’ mannerisms and ‘trades’ on his police status—first crossed my
path shortly thereafter…. He roughly challenged me about my call sign
immediately after I had called Geo. N9VTB—with ID. Instructively, this was only
after I added some closing comments in Polish…. I thought it improper of your
WHATLEY—who often attempts to intimidate others on-air by broadly ‘hinting’
that he is a policeman—
to do this in all the circumstances, especially
since he did not ID…. So, I addressed him by name/call sign [this surprised
him], informed him that I had been monitoring him for ~a month, told him that I
sought no conflict with him, strongly suggested that he not partake in the Mike
ND8V [now KZ8O] and Brian K3VR machinations against me and forcefully warned
him that he not cross my path again! In this first, short, testy, but
by-and-large ‘correct’ exchange, I also challenged your WHATLEY to point out
the worst characteristic about me/my operations on 20 m. Again, this appeared
to surprise him and all that he could come up with in reply was: “Arrogant”. I
retorted to the effect: “Guilty as charged!”
After this relatively brief but ‘frank’ exchange
of views, I thought that your WHATLEY would ‘smarten up’ and keep his distance.
But, this was not to be….
During the intervening months your WHATLEY has repeatedly
gone out of his way initially to ‘run interference’ for Mike and/or Brian—and
lately much worse….
For example, when George and I would be using
the frequency, Mike and/or Brian would disingenuously ask ‘if the frequency was
in use’—to which your WHATLEY would falsely reply: “No, go ahead and use
it.”…. Then the ‘games’ about ‘who was on 1st first’ [the
fundamental ‘law’ on amateur radio] and malicious interference would begin.
Lest the point escape you, it is not up to a third listener to determine for a
station wanting to use a frequency if it is in fact in use—especially when the
frequency is patently in use and they very arguably know it [I typically get
s9+30dB reports from MI, PA and FL, with all that implies].
Your WHATLEY would also often directly talk
over/maliciously interfere with our transmissions when in Polish [in part to
get away from unwanted comments/cat-calls, etc., if in English]…. When
challenged on this, he would transparently defend his actions to Mike, Brian
and/or us for having ‘mistaken’ our language/signals as coming from Europe.
This, when there was absolutely no propagation to/nor chance of Europe being
heard! But throughout, he would refuse to vacate the frequency as the
rules/logic demand. I say “transparently”, above, advisedly, in part because he
had earlier stated to me that ‘he supposedly understands some Polish because he
apparently knows a little German’ [which only confirms his linguistic and other
cultural ignorance/insensitivity]….
Lately, your WHATLEY and Mike and/or Brian have
been conspiring using a disingenuous variation on the above themes to interfere
with our transmissions…. First Brian would at low power ‘slide onto’ the
frequency in use by us, shortly thereafter joined by Mike and/or others at
moderate power, all pretending that they can not hear us because of propagation
or otherwise. Then your WHATLEY would come in at maximum power and attempt to
‘blow us off’ frequency. When challenged, he either pretends that propagation
[‘miraculously’] improved, or that he is “conflicted” [his word]. He often also
pretends not knowing “objectively” [again, his word] who was on frequency
first—us or his friends Mike and/or Brian—but then invariably/instructively
refuses to cease interfering and stays on frequency, typically until we are driven
off…. He is just a big bully!
In closing, it should be of great interest to
you that there is evidence that: Mike is a racist/white-supremacist/Ku Klux
Klan apologist/policeman ‘wannabe’—and an organic mental defective; while Brian
is a cyberpath, arguably a sociopath and possibly even a psychopath—reportedly
with a checkered ~‘policeman’ past…. Both have engaged in quasi-criminal
behaviour on the airwaves, via the Internet and otherwise. The question
then arises: why is your WHATLEY routinely not only keeping their
company/running interference for them, but actually also engaging in similar
~illegal on-air behaviour himself? Could it be because of his routine dealings
with criminals, he has learned their tricks/likes their tradecraft?
Irrespective, from my experience/in my
considered opinion you have a serious bully and a disingenuous personality
in your Department—with all that entails….
