This aptly illustrates what happens if you leave some marginal humans to their
own in an unsupervised setting. Eventually they have a few six-packs, don
their hoods, and torch some churches. Unfortunatly, once they
tire of their current activities they may just raise them to a higher, and
a more dangerous, level once they have a few beers and find their hoods.
People like Riley fail to recognize the dangers of failing to act early and
effectively. We pay him to protect us but I fear that the affair
will continue to rise to greater levels once verbal amusements no longer
satisfy the warped minds of the tribe. I wonder if Riley will
then have any guilt about his supposedly "goofy" function
to-date.

very important to use Ten Meters and run them off. Unlicensed stations
have no rights.
They have to be talked over, tested over, anything to get a
signal on top of them to run them off.

sends warning letters to so called "rule breakers" based only on
accusations from other amateurs. This is WRONG! All it takes is
one disgruntled idiot who, for whatever reason doesn’t like you, to cause
you undue trouble…. Riley doesn’t even bother to find out if this is true
until after the fact. Under this system, anyone can turn
in anybody with or without grounds! Kind of reminds me of SS
policies back in WW2. Or the way the Russian system worked during
communism with their KGB goon squads. True or false, all you had to be was
accused and you were in for trouble!
The FCC cannot expect amateurs to police themselves without
inviting some fraud…. Look at the VE program, what a
joke! Just imagine how many licenses were bought that haven’t been
discovered by the FCC. While the majority of amateurs are good people,
there’s always rotten apples in the bunch. One person could submit
numerous complaints to Hollingsworth and never even be on the air! After
all, how would Riley know since he acts only on emails and letters? Anyone
with a PC could digitally edit a tape and create a false one as well. The
person submitting the complaints doesn’t even have to know the amateur he
turns in to cause them problems. Does this sound like a fair policy?
The only way the FCC will ever be fair about this, is to go back to
monitoring the bands themselves and forget lame OO`s and taking the word
of amateurs alone…. The FCC needs impartial monitoring
stations like it once had to avoid facts being twisted into lies…. If Riley
didn’t hear the actual on air violation or hear a tape recorded by
commission officials who are impartial, then how can he be expected to be
fair about making a decision? That’s like expecting a judge to rule by
only hearing the prosecutions side of the case! Guilty before proven
innocent may work for commies and third world countries, but I would
expect the opposite from the good ole US of A!

On one hand, I can see where Riley is coming from with the
lighten up bit. However, he is being paid by US tax dollars to do a job. And that job is
enforcing the regulations on our amateur bands. Simply
telling us all to lighten up and spin the dial isn’t solving the enforcement
issues on our bands. Going after and busting the problem operators who break
the rules will. Its the typical cop out attitude of government officials who
pass the buck and just expect others to deal with the crap while they get
paid.

times about the same type of interference, with seemingly endless

It sound like in some cases Riley was not neutral and
had chosen sides in a matter. Thus he was

final straw for me was his speech at Dayton this year, the one which
basically urged us to stay off certain "trouble" frequencies

committing minor infractions, but those that were even breaking laws that were
enforceable under the FBI, ATF and Homeland Security were never touched!

The low budget also
made the mere threat of action a cheap means of keeping the inmates in line, but this is where things became problematic. Instead of
blowing off the obvious
cranks and vendetta seekers, he
took many of these grudge-bearing
correspondents at their dubious, Crayola'd word. The
burden of proof of innocence was then placed squarely on the accused op. For the average ham, challenging these allegations
was too involved, costly and time-consuming a process, and they settled for a
public flogging rather than fight the good fight.
Speaking of public slaps, the nadir of Mr. Hollingsworth's tenure had to be the
public humiliation of accused operators via terse, ominous notices
"leaked" to the ARRL, an organization that should have had the balls not to print
them. Over the years I've seen
many such notices - but never a single retraction. It's shocking that more hams haven't filed
character defamation suits against both the Bureau and the League.

I would like to offer up some "low hanging
over-ripe fruit" for Riley to get back into the swing of things.
14275 begs for enforcement. With a quick surgical strike to three American
amateurs, 95% of the problems there would be solved. Of course, the biggest offender there is KZ8O. His recent
performances during the Illinois QSO party two weeks ago, and then again last
weekend during the CQ WW DX contest, were some of the most hideous displays I
have ever seen in 31 years as an amateur. Never was I so happy that we were at
the sunspot minimum lest the entire world could hear this mess. Taking KZ8O off the air would take about 10 minutes of
focused work by the FCC.
After KZ8O is firmly and possibly permanently in the penalty box, the next light housework job on 14275 would be to take W4NTI
and K3VR off the air. In addition to KZ8O, these
particularly offensive Bobbsey twins have done more to ruin SSB on 20 than
anyone in the history of amateur radio, all the while
claiming to be trying to save it…. A year or two of listening only, if
you're very lucky, may give you the perspective you need.

The problem is that Riley H. and other

"investigation" is not an investigation. It is ‘he said, she
said’. Charges can be trumped up. For instance,
not only was I falsely accused by Glendal Floyd w5wec in Arkansas, I wrote him
to try to resolve any issues he had and he refused the letter and sent it back
unopened. This is the caliber of folks who like to

I heard the whole thing last night.
I tuned to 3950 at around 0900. At around 10:00 Eastern a W1 asked
if the frequency was in use. There was no response. He asked again,
again no response. He then called CQ and began a QSO with another
station. About 5 minutes into the QSO several stations came on, one of
which was loud enough to arouse suspicion regarding his output power.
They began telling the stations in QSO that they
had the frequency first and had merely gone to get refreshments. None of
this was true of course, since none of them were there the entire time I was
listening, up to and including when the W1 station made his call. [Ditto, mutatis
mutandis, ~daily on 14.275 for the past ~6 years.]
Long story short, they bullied him off
of the frequency all the while claiming innocence
and that it was all the W1’s fault.
I don't know any of these people, but what I heard was truly sad.
Amateur radio used to be populated by intelligent people; I did not hear
anything even close to intelligence. What I did hear was channel 19 at
its worst. I also noticed that two stations avoided
identifying, while a third gave a phony 1 by 1 call, so they obviously knew
what they were doing. [Sad,
after 9 years, Riley still does not know what HE is doing.]

I can’t say I'll be sorry to see him go. Hes been collecting a

enough to fall for their bull_ _ it. One "unnamed" member of that bunch lives
here in Fl. and he’s just as argumentative and confrontational on 75 as he is
on 20 when he’s attacking the Canadian. He obviously enjoys it so much he can’t
get enough of it. He even digitally records his "adventures" and brags
to the few who still talk to him and plays the recordings on the air as if it’s
something to be proud of. Go figure.
That
small bunch of outcasts lives for fighting, bickering, threatening and whining
like a bunch of spoiled brats while Riley sits back and does nothing. It must be nice to have
a job that pays you a salary for sending out form letters to the same people
over and over. No thinking or effort needed, just hit the print button and send
it off in the mail. Then, there’s the famous K1MAN case. I’m no fan of Glenn’s
silly bulletins, but how can Riley go after him for doing the same exact thing
the ARRL is doing? I imagine this is why 3 years after the fact Glenn is still
at it and legally the FCC wont stand in the way of his renewal if they haven’t
done anything by now. I imagine right after July, Glenn’s license will be
renewed and for the next 10 years he will be doing what he does best. If this
was a clear cut case Glenn would have been long gone. All I read about in the
"enfarcement" logs is repeater crap about someone who doesn’t want a
ham they don’t like operating on their repeater. Wow, tough enforcement task
there. Threaten someone with a fine and action against their license for p_
_ing off some repeater trustee. All this while half a dozen morons pollute 20
meters for over 10 yrs. I hope Riley’s replacement is a fair and impartial
enforcer who isn’t blind to facts and very "selective" in his
enforcement actions. As much crap as some have gotten away with, it almost

The last FCC special counsel was a man who
did not have the balls to enforce regulations.
He also didn't do much work -- he should have been sending out over 100
enforcement actions a month, and he should have reigned
in you and your friends. He did not. He sent out an average of
two letters a month to people who were using repeaters that they had been
banned from -- some record…. Hopefully, the next one will have a work ethic and
try to clean up the bands.

- There are
two specific examples of Hollingsworth's work with which I was and remain
personally angered. The first is the unwillingness to prosecute
a false complainant in Florida. The second, also in
Florida, was the failure to prosecute the theft of a club callsign by the ARRL West
Central Florida Section Manager, using the ARRL's VEC system. Both examples show
reluctance to apply the law fairly and equally.
Also, there is an even deeper concern, related
to the first example above. The idea of publicizing
accusations ahead of their adjudication for all to see. In the
above example of the false complainant, the wrongly accused ham had his
name plastered all over in one of those public "Enforcement
Letters" and was defamed based upon a restatement
of the false complaint. A very small retraction was later released. But, the identity of the
false complainant was never released and he wasn't prosecuted
for making false statements to a federal officer
(Hollingsworth) as he should have been.

- I have
followed W6WBJ's case since the start.
I have a couple of friend's caught in the same limbo.
The
limbo was created by NON-FCC "intel" gathered as a vendetta
against operators these "operatives" didn't like.
Mr.
Hollywood accepted this "intel" as being the very same value as
"monitored by FCC personnel". It is
not. This intel has no integrity in the
system as it stands. It is clearly not objective or unbiased, nor is
it a direct result of Enforcement by FCC employees.
WBJ is doing what many who are & have been victimized can't. He is
standing the ground & demanding he face his accuser. Since Hollywood accepted the
trumped up "evidence" from his backdoor minions, he then
becomes the accuser. WBJ is justified in his demands. If it weren't for
him, this charade would have continued if Hollywood didn't run for the
doorway of retirement to get out of answering WBJ's
questions WBJ has a right to ask under our Constitution. The ALJ
apparently sees it that way as well. I suspect WBJ's case will simply be
dismissed, as it should be... All "pending (for years)
"cases" should be disposed of before we "waste more
precious FCC resources". All Hollywood's Witch Hunt should be
closed & disposed….
I have to laugh at all the praise heaped onto Mr. Hollywood. What exactly
had he done to earn this praise? IMHO: Nothing... He last busted a jammer
on October 18th 1998 when COMMISSION agents busted KA2YBP (now W4YBP)
jamming the 7240 SWL Net... That only happened after we endured YBP's
jamming for 13 weeks, like clockwork...
Quite a "dry spell" from actual, on the ground, enforcement!

- FACT: The jamming
problem on ham radio is now much worse than it
was when Hollingsworth became "SCARE".
FACT: Riley made so many serious blunders that there had to be one or both
of two reasons for them: (1) contrary to the League's claims, he simply
had no knowledge of Part 97 and no
on-the-air experience before becoming
"SCARE"; and/or (2) he intentionally misinterpreted Part
97 in order to make his job easier by bluffing the amateur community.

I’m concerned, we didn’t have enforcement when Hollingsworthless was in
charge so what’s the difference? His brand of "enfarcement" was

97 daily. Being fair and impartial was not one of Riley’s strong points. I have to
laugh when I read some of these cheerleaders heaping tons of praise on

Not true, they provided 1000's of cassette tapes so Riley could build his
retirement house with PlastiWeld. However, he could not listen to any tape
& not be at a total loss for context or the identity of the
participants. He resorted to using OO & "3rd party"
hunches a.k.a. vendettas to "enfarce" his invented brand of law. Ever
notice in "Warning Letters" during Hollywood's tenure, the words
"as monitored by COMMISSION" were nowhere to be found?
OO's were just 1 of many willing "pawns" in his witch
hunt chess game. His legacy at the Commission is a huge pile of
unfinished "proceedings" that should never have been put on
paper. I can name 5 cases at least...

that he was clearly instructed by his superiors NOT to involve the regulatory

agency, relying instead on intimidation, bluster, administrative threats,

If I may, I'd like to share some of my opinions on ham radio and the job
you're about to undertake….
First, let's assume the ham bands are like junior
high, except not quite as sophisticated.
Generally, like-minded souls find one another and form cliques; these
cliques tend to grow hidebound, shunning visitors from without, and
critical of all other cliques. Some lone wolves keep to themselves, and here
and there the rogue troublemaker wanders through the halls setting fire
to lockers.
Continuing this metaphor, say that in the name of discipline, the
principal invites the student body to anonymously snitch on one
anothers' transgressions, then publicly humiliates the alleged
troublemakers without corroborating evidence. Such an
inherently unfair and non-credible process would quickly buckle under the
sheer weight of spurious, vengeful complaints.
This describes the state of ham radio enforcement over the past
decade. In its wake lies a generation of hams whose notion of
"self-enforcement" has become "I'm gonna tell Riley on
you!"
This is an unhealthy situation, sowing fear and intimidation instead
of the good will of reasonable process coupled with the teeth of proactive
enforcement…..

- I am
talking about Mr Hollingsworth's network of 'informants'. This
subject has been broached by hams for years. Here is what I know:
I have an entire packet of information (unsolicited) from Mr
Hollingsworth asking me to help him in building a case against another ham; and
detailing what he already had. This ham was a pain in the ass to be sure,
but I had not personally made a complaint against him. A number of
my 40m group were approached in this way as to this same ham. As I said
in another post, my lawyer strongly advised me against this.
Another ham friend, whom I have known for over 25 years, was
essentially recruited as a 'spy' against another group. His
activities included almost daily cell conversations with RH for
months. This is fascinating, as this ham was/is a part of my 75m
group which many have considered to be very
controversial if not outright outlaw for 26 years. True or
not; my friend believed that if he cooperated with RH, his more questionable
75m activities would be overlooked.
Another group of rowdies on 40 had at least 4 of their members
recruited to gather evidence against another group on 40. I know
this personally to be true as I have seen the
correspondence. Rumor has it that this was also true
with a couple of situations on 20m.
That is how I define "snitches".
Since these are just the ones I know about, how many were
there that I don't?

himself. I never got a response.. not even a "thank
you for the email".
This was about 8 years ago.
As far as my lawyer (Wj4G/sk who early in his career had been an attorney with
a federal agency); he mentioned potential civil litigation from the
target ham, and then was rather cryptic as to potential issues with the FCC.
Saying that if they so desired (got pissed?) to "turn
something around on me", I could have trouble with the
Commission itself. This was based on his assessment of Riley Hollingsworth, of whom we had many
conversations. I didn't inquire further on this issue.

If Ms. Smith issues a formal (and published) notice to someone accusing
him/her of wrongdoing, the very least we should expect is that she has solid,
verifiable evidence for same - not the nebulous "information before the
Commission" that Rileygrams always referenced but never
elaborated upon.
If said "information" is unverified, a request to the accused
party to provide more information is in order but it should be kept
confidential until the accused party issues a formal reply to the
request and the credibility of the evidence behind the complaint is
established. "No credible evidence, no formal publication"
should be the rule.
"Lauragrams" (if that is the proper term) should not be made
public unless and until the evidence for same is deemed credible. I use
the term "credible" in the strict legal sense, not in
the Riley sense of "I'm sure it's credible because I know the guy
who complained and, besides, I don't like the guy he's complaining about." [ß Touché!]
A number of people who had Rileygrams published in the enforcement actions
section of the Commission's website (and in QST) eventually got one-liners
from Riley saying, in effect, "We accept your reply and we're
dropping the issue." In other words, "The complaint was bogus
in the first place (and we knew/should have known this), so to save face we're
letting you off the hook and we're not going to do anything to the idiot
who filed the false complaint against you."
Or, distilling the foregoing down to street vernacular, "[FUCK] you if you
can't take a joke."

to him on the phone regarding an accusation against me that was bogus. He was unwilling to
hear my side of the situation at hand. Totally amazing how he sided with the other
parties and didn't have all the facts. I feel because of his
unwillingness to hear my side that he was personal friends with the other
party. But I also didn't like his practice of publishing
other accused parties’ personal addresses and the accusations against
them. Too
bad they all didn't band together for a class action lawsuit on him. He
needed to be knocked down to his real size.

like the addition Riley Hollingsworth to the staff of QRZ will have the
effect of "cleaning up" this forum; above and beyond the
stated rules here.
In both cases the root mentality is that of "teaching" people how to
think and what to express openly. I am reminded of Orwellian
totalitarianism.
