RE: COMPLAINT—Detective Thomas A. WHATLEY, Jr.

Dear Chief Schroeder:

This is further to my original letter of complaint dated 10 June 2006 the intervening correspondence and the most recent reply dated 6 September 2006 from your Lieutenant Marc Woods stating that the command staff of your Department found “no definable acts of misconduct” by Whatley….

I am of course disappointed in the “finding” such as it is, in all the circumstances of this case.

Enclosed is a CD of a recording I serendipitously found in the far recesses of the Internet after receiving the above letter…. The recording captures part of a radio conversation I had on the afternoon of Sat. 9 September 2006 on 14.273 MHz USB. Interestingly, this was less than three days after the date on your Lt. Woods’ letter….

On the ~19 minute tape, which is otherwise disturbingly self-explanatory, you will hear:

· Me N9VTB [I’m the one with the accent] talking with Karol VE7KFM

· My friend Karol obviously talking with me

· Your Whatley [constantly maliciously interfering, gratuitously using obscenities “mother fucker” (~7x), “asshole” (~9x), “Fucking Polak” several times, repeatedly threatening my FCC licence, threatening me and my wife generally, etc., etc.—all without any provocation whatsoever]

· Mike ND8V/kz8o who was instrumental in “importing” your Whatley to 20m as advised [he’s the one initially/repeatedly asking ‘Tom to meet him on 275’ and at the end making obscene comments towards/about my friend Karol and also engages in obscene ethnic slurs (“Polak faggot”, etc.)] and

· Other malicious jammers who did not identify, but who are known to/in the group of which your Whatley has been a member for quite some time….

I would like you to carefully listen to the recording—apparently made by those adverse to my interest and which I was obviously not meant to hear….

Then, I request that you re-open the file and consider this “new evidence” in the proper disposition of the case.

In the alternative, I request that you consider this a separate complaint along the same lines as deposed to previously, incorporating as ‘similar fact evidence’ the materials on file adduced earlier and addressing the new areas of concern self-evident in the recording….

In closing, be advised that I have since learned about your Department’s less-than-enviable relationship within the community you are charged to protect—and again re-iterate that you demonstrably have a ‘bully’ within your ranks, with all that implies in the circumstances….

Your prompt and thorough action on this is expected.
