After several QRM'ing re-broadcasts--N.B. "expertly" keyed, as usual, so as to obliterate the weaker Japanese station--Gary started to complain about the "VE7 station" supposedly jamming/QRM'ing him and repeatedly stated the obvious, viz.: that the freq. was in use.... I therefore very laconically advised Gary, whom I don't know from the proverbial Adam, that the clip being used to QRM them was a 'spoof' of my call-sign/voice, likely coming from KZ8O near Kalamazoo, MI.
  
  Surprise, surprise, ~immediately after Brian CROW K3VR anonymously broke on freq., joined within seconds by Randy BEST W7CPA [one of the 14.275 MHz Mafia], all three of whom appeared to be waiting in the weeds by pre-arrangement.... They eventually drove Gary and 'Ted' off the freq.
  
  FYI Brian K3VR initially talked about you generally, then specifically to the effect that you're under-funded and that [N.B.] you/the FCC likely won't go to the trouble to catch a perpetrator [i.e. them]. He then twice in succession FRAUDulently accused me of jamming them and later, using another Bald-Faced LIE as usual [and barely able to suppress his mirth], perversely said words to the effect that 'I was QRM'ing myself, but from a remote station I had set up in Kalamazoo, MI'.... • Randy, I know you can understand how the FCC can get carried away in its amateur enforcement efforts because you experienced their incompetence and ineptitude personally. Normally I would not get involved in what on the surface appears to be a "he said/she said" type of dispute. I am not going to comment as to who was on air first on Sunday -- but both sides are advised that I have tapes of the entire afternoon -- and these tapes did not come from either side (at this point I wouldn't trust a single thing given to me by either side -- as both sides have proven to be so intent upon proving that they are "right" and the other side is "wrong" that they will do and say just about anything to further their cause -- however warped that cause may be). I do feel, however, that some guidance is necessary (that and the fact that I have just about reached the end of my rope with all the players in this little drama!).

Randy -- I don't particularly like what Karol says on the air -- but that does not mean that you (or anyone else) has the right to try to drive him off. I have spent hours listening to tapes (hours that I will never get back, mind you!) and to tell you the truth, even if I did have jurisdiction over Karol (which I DO NOT) nothing that I have heard thus far rises to the level of an actionable complaint. For future reference, in determining what is or is not legal over the air, it depends on what he is saying. The FCC regulates obscenity . . . but general cursing and references to body parts (while certainly obnoxious) does not necessarily rise to the level of obscene speech. Likewise, calling the President names and making general anti-American comments (including comments regarding wishing the terrorists would attack us again and the like), while a sure sign of a lack of sensitivity (not to mention maturity), does not rise to the level of obscene or hate speech either.

Indeed, were Karol an American, his speech would fall squarely under the 1st Amendment -- you know that thing many of our forefathers fought and died for (not to mention our troops overseas right now). When you call yourself patriotic, built within that statement is the acceptance of the Constitution and all it entails -- free speech is one of the cornerstones of that fine document. It doesn't mean only the speech YOU agree with; or only the speech that the majority of folks agree with; or even only speech that isn't offensive to most mature, rational adults. It means ALL speech -- the good, the bad, and yes, even the ugly (as Karol is quite often want to spout). (Ok, before you decide to shoot back at me -- yes, there are some types of speech that are restricted. No shouting fire in a crowded theatre or hate speech -- but those are clearly defined by the courts and nothing Karol has said thus far falls into those categories.)

I have requested that Karol tone down his "act" -- (and if you don't get that it is an "act" -- you missed the whole point of his exercise with you and your buddies at 14.275. He is TRYING to incite you -- and succeeding admirably as you all have fallen into the trap.) However, I can promise you that he will/has not responded favorably to my request. He is going to continue the "act" -- and you guys thus far have demonstrated that you are going to continue falling into his trap. What does that say about the cognitive abilities of the Americans as they are all being led around by a master manipulator.

I sure wish we could regulate stupidity -- but it just isn't within the current confines of the rules. If it were, every single one of the actors here would be slapped with a fine just for being stupid/gullible and wasting my time (not to mention the years that Riley wasted trying to bring you guys back in line). What is within the confines of the rules, however is that fact that I can (AND WILL) enforce the rules against any Americans who cause harmful interference to Karol (and any of the folks who elect to engage him in QSOs). Let me repeat that so everyone understands it -- RETALIATORY JAMMING WILL NOT BE TOLERATED AND IS IN VIOLATION OF THE RULES!

I hope you all got my message here -- I have just about had it with the juvenile antics on the part of the American licensees. By the way, playing bulletins and tapes of a deceased licensee repeatedly in an effort to tie up the frequency so that Karol (and others) cannot use it actually does rise to the level of malicious interference -- and is subject to a possible enforcement action. Likewise, I won't even go into the ridiculous sound effects, endless playing of music, and general pre-pubescent behavior that quite a number of folks engage in on a daily basis at 14.275 -- again, all in an attempt to prevent Karol from engaging in QSOs. It needs to stop and needs to stop right now!

Can you tell I'm pissed? If you haven't yet figured it out let me clue you in here -- this behavior either stops now or everyone involved will find themselves on the receiving end of enforcement letters. I was in QSO long before your incredibly foul mouthed friend (VE7KFM) came
on frequency with 3 other operators. His claim that he is associated with
Radio Canada is not true and an insult to the fine RC organization. I
currently work for the Canadian Government (DnD) and I can assure you this
guy is a major league nutter. There are 40+ minute tapes to confirm this.
We were discussing audio and older radio restorations. Propagation can play
many tricks. In the future please feel free to notify me WRT your
displeasure. I full well understand that vile language it hard to prosecute
these days and perhaps you are fan of this behavior. If so, so be it.
 
I suggest that we all help the FCC in the enforcement area with unidentified
jammers and foul mouthed crazies. Please give me a call at 602 266 2256 to
discuss how we can better assist the FCC on serious matters. I would be glad
to show you my station and my directional antennas. Ground wave on 20 meters
is very poor from your West Phoenix location. With my antenna pointed East,

Dear Mr. Best:
 
I was having a QSO with Karol Madera yesterday, and you were 
qrm'ing the frequency. I am going to politely ask you to refrain from 
QRMing my QSO's in the future. I have an absolute right to 
communicate with whoever I wish, and if I wish to talk with Karol, 
that is my business, and not yours. I would not dream of interfering 
with your QSO's, and I expect the same courtesy from you.
 
When the sunspots come back, we American Amateurs are going to look 
like a bunch of spoiled squabbling children to the rest of the world, 
if these antics continue. I really do not want to have to make 
excuses for what everyone is going to be hearing on 14.275.

Re-read the above two independent ‘sets’ of e-mail exchanges—the 2^nd of which immediately above [which should be read from the bottom up] was contemporaneously NOT known to me….

Read them particularly CONTRA PREFERENTUM in Randy BEST W7CPA’s case [and incidentally note the very late time of his reply], because Randy W7CPA among other things, is a patent and transparent LIAR….

Why do I aver so strongly?

Let me perfunctorily count the ways:

• I started on a clear freq.—and have a lengthy audio-recording—from before the start to after the very end—to prove all of it.
• Immediately after calling my 1^st short CQ I had a small ‘pile-up’ starting w/ WA9APL, followed immediately by KJ4JGX [he actually ‘broke’ during the prior QSO], followed immediately by a dozen contiguous contacts, among them AJ4CU [no friend of mine], K3TP, PY3PDR [= Brazil], K9EE, WK7ED and finally ending w/ KE5GFJ.
• All but K3TP w/ whom I have spoken on average ~1-ce/per year, were ~1^st time contacts and “strangers” to me….
• At NO time did I relinquish the freq. in the small ‘pile-up’ or otherwise….
• I advised Laura SMITH of the FCC of what was going on—by leaving a lengthy recording on her answering machine of the ‘goings on’ in real-time—as well as provided her w/ the pertinent audio recordings further to her request [and offered to send ANY other selection she wished, as usual], prior to her broadside to Randy, further to Bill SHINE K3TP’s then unknown initiative, above….
• Unknown to me until after the fact, Laura SMITH’s official FCC agents were also—further to earlier ‘heads up’ and otherwise—apparently independently monitoring the freq….
• Etc., etc.

You get the picture: belt, suspenders and Velcro!!!

Yet Randy, a long-time member of the “14.275 Mafia” in general and toady of Brian CROW K3VR in particular, would aver—to a Federal Agent—that he “was in QSO long before” me, among other patently outrageous and/or disingenuous comments, in his reply to Bill K3TP and Laura SMITH….

How do you spell LIAR?

You spell it thus: W7CPA

The damning me w/ faint secret praise notwithstanding, Laura SMITH had multiple proofs, from several cogent sources, including her own FCC agents apparently, that not only was Randy W7CPA QRM’ing/interfering w/ me and my correspondents, as reported in part by Bill K3TP but even more importantly, that he had LIED to a Federal Agent!!!

To the extent that Martha STEWART went to jail for something very similar to this, Laura should simply have required that Randy swear to/affirm his allegation under Oath—and it could/would/should have been all over but for the crying….

Actually, Laura, it’s still not too late….

Unless you’ve been co-opted/compromised/corrupted—as I repeatedly warned you might be—as early as Jan/Feb ‘09….

And Randy, keep playing Criminal paddy-cake w/ the “14.275 Mafia” on-air and/or on the WWW against me and I’ll inter alia contact your APRIVA ISS and the US “Military-Industrial Complex” generally and our D/SECUR at DND in particular—who BTW is my Junior and always will be—and strongly suggest to all concerned that in light of your documented alcoholic, lieing, racist, violent, criminally interfering, defamatory, etc. “history”, you are a Security Risk and that they downgrade your security classification to RUMOUR….

GOVERN YOURSELF ACCORDINGLY—and no one will get hurt….
