Parking

As 1010 Howe was a former government building before its conversion into strata units, there are less parking stalls than strata lots.  Not each suite has a parking stall.  This unique situation has led to a strong position by the strata council on parking stalls. Due to the high number of rental suites in the building, rental tenants were using the parking garage at whim, and parking when ever and where ever they liked causing much disruption.

In an effort to curb this behavior, it was noted on numerous strata meeting minutes and the following notices were posted in the building:

The parking garage is patrolled on the weekends by building security, and during the week, by strata council members.  Any vehicle that does not display the proper parking stall pass / permits or is parking in violation of the strata rules for parking will be towed at vehicle owners expense.


Renting Parking Stalls

Parking stalls are assigned to specific strata lots ONLY, and are not transferable or sellable, as they do not belong to the actual unit, but are assigned for the exclusive use of.

Individual stalls may be leased or rented, ONLY TO OTHER SUITES in the building.  It is NOT permitted to rent or lease a parking stall to anyone person or business / corporate entity who does not reside in the building. (see above notices, and below parking rules and bylaws.)

B. PARKING

 

  1. An owner, tenant, or occupant must use parking stalls only for the parking of licensed and insured motor vehicles, trailers or motorcycles, and not for the parking of any other type of vehicle or the storage of any other item, unless otherwise approved in writing by the strata corporation.
  1. A Ten Ten Howe parking permit must be visibly displayed in the vehicle while parked in a stall.
  1. Use of car horns upon entering, leaving or within the parking garage is prohibited.
  1. Vehicle lights must be used at all times in the parking garage when the vehicle is in motion.
  1. No vehicle exceeding 9,000 lbs., i.e. G.V.W., trailers, campers, boats or motor homes shall be parked in the stall without prior written approval of the strata corporation.
  1. An owner, tenant or occupant shall not:

    1. use any parking space in the building or on the common property or on any limited common property, except the parking space which has been assigned to his or her strata lot, a parking space leased by the owner or, when specifically agreed with another owner, the parking space assigned to the strata lot of that other owner;
    2. utilize designated guest parking spaces for visitors for longer than twenty-four (24) hours without the written consent of the strata corporation. The strata corporation shall be entitled to impose shorter time restrictions on any guest parking spaces from time to time as may be required to control and regulate guest parking;
    3. carry out any oil changes, major repairs or adjustments to motor vehicles or other mechanical equipment on common property or on any limited common property, except in the case of an emergency. An owner, tenant or occupant shall be responsible for the cleaning of any oil or fuel spills in his/her parking space(s), and for any charges incurred by the strata corporation for the cleaning of such spills if the owner, tenant or occupant fails to do so after written notice from the strata corporation;
    4. rent or lease the parking space assigned by the strata corporation to his or her lot to or otherwise permit that parking space to be regularly used by anyone that is not a resident of the building;
    5. park any vehicle in a manner which will reduce the width of the garage roadway or ramp or any roadway on the common property or on any limited common property;
    6. attach any items to the floor of a parking stall nor to any wall, ceiling or support column adjacent to a parking stall.

2.3.    Use of Property

2.3.4   An owner, tenant or occupant shall not:

(d) give any keys, combinations, security cards or other means of access to the building, the parking garage or common areas to any person other than an employee, contractor, occupant or guest of the strata lot as permitted by these bylaws;

(k)  block, obstruct or use for any purpose other than ingress or egress from the strata lots and parking areas within the common property, the sidewalks, walkways, passages and driveways of the common properties;

19.1. Parking

19.1.1    Vehicles parked in violation of any bylaws or rules shall be towed at the vehicle owner's risk and expense.

19.1.2    All motor vehicles parked or stored in the parking facilities of the Development must be licensed and insured unless prior written approval is obtained from the strata corporation.

19.1.3    Only units with parking stalls will have fob access to the parkade.
