Feb. 2004: The case of R vs Don Smith continues, the appeal process is being scheduled for a date in Toronto, Ontario, the exact date has yet to be determined. It was supposed to be held back in October of 2003, then we heard it was going to be held in January of 2004. The original case was instigated back in October of 2001, so that says a lot about your right to a speedy trial here in Canada. We'll keep you posted of any news on the actual date for the trial where Dr Don's appeal process will finally commence.

Feb. 2004: CD SMITH ATTACKED VERBALLY ON A PUBLIC BOARD
On Febuary 13th, 2004 CD Smith, brother to Don Smith, was attacked publicly on a high-traffic adult industry message board. The person maligning him, known as Trey Hickey, is himself the owner of a large network of pornographic sites, yet he chose to cast disparaging remarks and false insinuations at CD for no apparent reason other than pure maliciousness. The really disappointing fact is that this IS the adult industry, not playschool, but anyone that has any first-hand knowledge of the Smith's case knows that they are fighting tooth and nail to preserve the freedom of artistic expression online... something some webmasters obviously take for granted.

Acacia Research surfaced in the early part of 2003 with a purchased patent in hand and had their sights clearly set on ANY website that utilized streaming audio and video. Their charge is  that those sites need to license their patent or stop using streaming audio/video. Obviously this is not acceptable to the adult online industry or any webmaster who values his or her business, yet Epic cash and a number of other sites have nevertheless chosen to crawl into bed with such a company. Feb. 2003: This past fall has been hectic, with wars being fought against censorship on many fronts. More and more websites and webmasters are falling to the cruel axe of this scourge, and we need to step up the pace in order to snuff it out, or at the very least slow it down. Let's face it, there will always be those fearful ignorant savages that would give anything to control what you are allowed to say, write, create or publish online. That's right, they are always going to be out there lurking in the shadows, trying to figure out new ways of furthering the cause of censorship. If you run a website that exercises your *right* to free speech or freedom of expression, and think that you have no worries, guess again.

Don Smith, known online as "Dr. Don" has lost the first round against the Ontario government's bid to censor him and ruin his reputation and livelihood. The cozy little kangaroo court in Fort Frances Ontario found him guilty of producing and distributing obscene material, and fined him $100,000 dollars. This fine is approximately ten times what the usual fines for this conviction are.
